Service provider (the company providing this platform): LudiSec (admin.ludisec@gmail.com)
1. Purpose
These Terms govern access to and use of the LudiSec platform, a SaaS solution for human-risk cybersecurity awareness and management (gamified training, phishing simulations, risk dashboards), aimed at companies ("Client") and their employees ("End Users").
2. Acceptance
By registering, subscribing to a plan, or using the Platform, the Client accepts these Terms and, where applicable, the Data Processing Agreement (DPA) and the Privacy Policy.
3. Registration and accounts
The Client appoints authorized administrators to manage the corporate account and is responsible for the accuracy of the information provided and for safeguarding End Users' access credentials.
4. Service description
Depending on the contracted plan, LudiSec provides: a catalog of cybersecurity trainings, controlled phishing simulations, a human-risk indicator dashboard (including the global classifier described in the Privacy Policy), gamification (XP, badges, leaderboards), and multi-tenant/reseller admin features where applicable.
5. Plans and pricing
Prices are published per seat/user/month (indicative range 13–17 € /seat/month, excl. VAT) and may vary based on volume, contracted features, or specific reseller terms (see Reseller Special Policy). Current pricing is confirmed in the commercial offer or at Stripe checkout.
6. Billing and payment
Payment is processed via Stripe. The subscription auto-renews per the contracted billing cycle (monthly/annual) unless cancelled in advance. Electronic invoicing is issued in compliance with applicable regulations.
7. Trial period and cancellation
If a trial period is offered, its duration will be stated at the time of contracting. The Client may cancel the subscription before renewal via the admin panel or by contacting admin.ludisec@gmail.com.
8. Acceptable use
The Client agrees to: (a) use the Platform only to train and assess its own employees; (b) not attempt to compromise the Platform's security; (c) not resell access except under an express reseller agreement; (d) comply with applicable data protection law with respect to its own End Users.
9. Phishing simulations
Use of phishing simulation features is additionally subject to the Special Terms for Simulated Phishing Campaigns, which the Client must accept before launching any campaign.
10. Intellectual property
LudiSec retains all rights over the software, training content, trademarks, and design of the Platform. The Client is granted a limited, non-exclusive, non-transferable license to use the Platform for the duration of the subscription.
11. Service availability
LudiSec makes reasonable efforts to keep the Platform operational; scheduled maintenance windows may occur and will be communicated in advance where possible. 100% uptime is not guaranteed.
12. Limitation of liability
To the extent permitted by law, LudiSec shall not be liable for indirect damages, loss of profit, or data loss arising from use of the Platform. LudiSec's total liability to the Client is capped at the amount paid by the Client in the 12 months preceding the triggering event.
13. Term and termination
The contract runs for the term stated in the contracted plan. Either party may terminate for material breach by the other party, following notice that remains uncured for 15 calendar days.
14. Changes
LudiSec may modify these Terms, notifying material changes to the Client at least 30 days in advance. Continued use after such changes take effect constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute shall be submitted to the Courts of Barcelona, unless mandatory consumer-protection venue rules apply.
